在美国超级英雄类型的电影当中，我们见过钢铁侠、蜘蛛侠、蝙蝠侠，也见过超人、绿巨人、蚁人等等。错综的故事情节，酷炫的武器装备，绝伦的特效，次次戳中观众们的爆点，形成了一个巨大的产业链。在外贸行业当中，这些可是越蹭越火的热点！

但是，上面所说的这些超级英雄，却并非都是来自同一出处。其中钢铁侠、蜘蛛侠、绿巨人、蚁人，是来自漫威，而蝙蝠侠和超人，则是来自与漫威齐名的漫画巨头——DC漫画公司。

这些超级英雄，在我国也同样有着很高的知名度，提到一个名字，我们的脑海里就会自动浮现出他们在漫画或电影中的形象。从商标方面来看，拿蝙蝠侠为例，据查询，申请“蝙蝠侠”类似商标的也有87件之多。

今天，我们着重来看一下第17873092号“蝙蝠侠BATXIA.COM”商标。此商标是刘某于2015年9月10日申请，2016年12月21日被核准注册在第12类，飞船、飞机、飞艇、水上飞机等商品上，专用权期限至2026年12月20日。

2018年1月17日，DC科米克斯合伙公司对其提出无效宣告请求，并提出了一件引证商标，即第3363155号商标。

第3363155号商标是DC科米克斯合伙公司于2002年11月8日申请的，2004年1月21日被核准注册在第12类，自行车，车座套，婴儿车，陆、空、水或铁路用机动运载器等商品上，专用权期限至2024年1月20日。

商评委认为，首先，争议商标与引证商标含义相近，共存在同一种或类似商品上，易造成混淆误认，已构成使用在同一种或类似商品上的近似商标。争议商标的注册违反了《商标法》第三十条的规定。

并且，《商标法》第三十二条规定：“申请商标注册不得损害他人现有的在先权利”，知名商品的特有名称为上述在先权益之一。“蝙蝠侠”/“BATMAN”作为影视作品的名称在争议商标申请日前已为相关公众所了解并具有一定知名度，应当作为在先权利得到保护。

争议商标与申请人影视作品名称“蝙蝠侠”/“BATMAN”含义相同，在其指定商品上注册使用，容易导致相关公众误认为其经过权利人的许可或与权利人存在特定联系。申请人注册争议商标的行为不当，利用了申请人知名电影“蝙蝠侠”的知名度和影响力，挤占了申请人基于该电影名称及其人物形象名称而享有的市场优势地位和交易机会，可能损害申请人的相关合法权益。故争议商标的注册已构成《商标法》第三十二条所指“损害他人现有的在先权利”之情形。

其实不光是超级英雄等等这些 知名形象会遇到类似商标问题，不论你身处哪个行业，哪个 或是地区，都需要提高商标保护意识，以免造成不可挽回的损失。
